Abstract
The purpose of this article is to analyze thesubstantive crimes created by article 245 of theTurkish Penal Code Number 5237 (TPC) in the light ofthe main principles of Turkish criminal theorygoverning the evaluation of the actions as offences.The analysis includes a discussion that some items oflegislation are contrary to law; particularities of theoffences; the investigation and prosecution stages,and the reasons that act to mitigate punishment andenforcement. Turkish Appeal Court decisions will bementioned accordingly.
