Abstract

In 2008, medical experts around the world gathered in Istanbul to define the standards on organ transplantation and preventing organ trafficking under the leadership of the Transplantation Society and The International Society of Nephorology. At the end of meeting, they agreed on a bunch of principles which is called as Declaration of Istanbul on Organ Trafficking and Transplant Tourism to advise countries to take steps by preparing legislation which can lead to encourage states to transplant from deceased and living organism.

Although the Declaration is not binding document from legal aspect, it is prominent for standardization on transplantation. by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability, or of the giving to, or the receiving by, a third party of payments or benefits to achieve the transfer of control over the potential donor, for the purpose of exploitation by the removal of organs for transplantationaccepts that as organ trafficking by being compatible with article 4/b of Council of Europe Convention against Trafficking in Human Organs.
